Independent American Party Files Writ of Mandamus

To Force Registrar Lomax to Register Lance Hinton to Vote

& Sign Him Up As Candidate for Clark County Treasurer

Jonathan Hansen, the attorney for the Independent American Party of Nevada, filed for a Writ of Mandamus today, asking the court to order Clark County Registrar of voters Harvard Lomax to register Lance Hinton, of Las Vegas, as a member of the Independent American Party and then sign him up as the IAP candidate for Clark County Treasurer. Lomax denied Hinton the right to vote and to sign up as a candidate because Hinton added a comment at the bottom of an affidavit that he reserved all his rights.

 

Hansen said that after reviewing the law in question that not only had Lomax violated the law but that the law was unconstitutional on its face and never should have been followed in the first place. “We will be challenging both the administration of the law by Lomax and the constitutionality of the statute,” said Hansen.

 

Lance Hinton was personally denied the right to vote by Lomax and not a deputy registrar. “I told Mr. Lomax that he was violating my constitutional rights by not letting me register to vote. Then he told me to sue him so I am just following his advice,” laughed Lance Hinton.

 

“This law is in violation of a long standing Nevada Supreme Court ruling from clear back in 1888,” said Jonathan Hansen (candidate for Clark County Assessor), “back when the Nevada legislature tried to outlaw Mormons from voting.” The Nevada legislature has once again tried to change the requirements for voting in Nevada and the Supreme Court has already clearly stated that, “The right of suffrage, as conferred by the constitution, is beyond the reach of any such legislative interference.” In State v. Findlay, 20 Nev. 198, 19 P.241 (1888). 

 

 The legislature has once again tried to pass laws they have no authority to pass. The people and only the people can determine what is required in order to be a voter in Nevada and those requirements are found in the Nevada Constitution in Article 2 Section 1.

 

Christopher Hansen, the State Chairman of the IAP is also a part of the suit representing the 26,632 Clark County Independent Americans that are being denied a candidate and an opportunity to vote in the Treasurer election. “The current Treasurer does not have an opponent and Lomax has kept voters from having a choice. That is just wrong so when I heard about this I knew we had to sue him again. We are already in a federal lawsuit with Lomax because of his action in helping to stop the Axe the Tax petition, which kept voters from voting on that issue. It is obvious that Lomax does not follow the Constitution nor does he support voting rights.”

 

“The odd thing about this law,” said Hinton, “is that they refused to accept my affidavit concerning the fact that I did not have either of two documents that no one is required to have to vote in the first place. Why would I have to swear that I do not have documents that I am not required to have? It is a stupid law.”

 

“The Independent American Party or it members have had to sue the State several times concerning voting laws, candidates and even registering to vote. “This is just a continued pattern of harassment by State and County officials and employees that obviously do not like the Independent American Party and its continued defense of the Constitutional rights of all Nevadans. What they want is for us to just shut up and do what they tell us to do. Well we just want them to follow the U.S. and Nevada Constitutions and they seem to have a real problem with that,” said Christopher Hansen.

 

“It is becoming a pleasure to sue these petty tyrants. After all as Thomas Jefferson said, ‘rebellion to tyranny is obedience to God’”, concluded Christopher Hansen.
